The Association of Settlement Companies (TASC) has established an online resource that provides information concerning TASC itself and the debt settlement industry as a whole, including news and updates about industry issues. As discussed on its website, TASC is an internal watchdog group within the debt settlement industry. TASC’s goals are to “promote good practice in the debt settlement industry, protect the interests of consumer debtors, and lobby on behalf of debt settlement companies on the federal and state level.” The TASC website features many useful tools that consumers may use to choose the best debt settlement company for their needs. The website includes the article “Top 20 Facts You Should Know about TASC,” as well as an About Us and FAQ section. These resources explain in detail what sets TASC and TASC member companies apart from other companies in the debt settlement industry, and why TASC membership is important.

Several things set TASC apart from other industry organizations. One is that TASC members proudly advertize their association with TASC. The TASC website lists all member companies, provides contact information, and links to their individual websites. Another difference that separates TASC from other organizations is TASC favors legislation to protect consumer rights. The debt settlement industry as a whole is mostly unregulated. Other debt settlement organizations believe in a free market system, believing that bad companies and bad practices would be weeded out by consumer dissatisfaction and word of mouth. TASC, on the other hand, prefers to have mandates in place that protect consumers upfront, instead of waiting idly by while companies take the money out of people’s pockets without ever performing any of their contracted services. As detailed on the website, the ultimate goal of all of TASC’s efforts is to provide the best possible services available to consumers.

What are the best methods for securing a debt consolidation loan considering the following criteria. I have $85,000 in credit card and unsecured debt.

1) I am not behind on any of my debts. All have been paid on time.

2) My main goal is debt consolidation with a lower interest rate. All cards will be closed.

3) I do not want to use any debt relief companies. Only reputable sources such as banks or other mortgage lenders.

4) Home equity is not an option. I do not have enough equity nor would I want to a 2nd even if I did.

5) I am not trying to settle for less on the principal balances.

Just want a reasonable interest rate for all. Do such debt consolidation loans exist? Banks? Peer to Peer? Other mortgage lenders? Regards -

Thank you for your question. Closing credit cards and debt with good standing history – on time payments, low credit limit to balance ratio, long credit history, etc. – could negatively impact your credit score. Therefore, is not recommended. As you know, the credit score helps determine the interest rate you get on future mortgage loans.

Since your main goal is to lower the interest rate, one thing you can try is contacting your creditors and ask them to lower their rates. Tell them what you plan to do if they first say “no”. There is a good chance the creditors will choose to lower your rate and keep you as customer rather than letting you go. -Source Dallas Morning News

Debt consolidation is not the same as debt settlement or debt negotiation, which many people are not aware of. Some debt settlement companies charge money upfront as an initial “admin fee” to set up your account, plus a monthly service fee. The fees vary depending on the company and the amount of your debts.

Such debt management companies take your money every month, but don’t make monthly payments to your creditors! Instead, they put it in a trust account, negotiate your debts with your creditors, then make a lump-sum payment when there’s enough in your account to pay a creditor in full.

That can take years depending on the amount of debt you have with each creditor. Meanwhile, you can be sued by your creditors and your wages can be garnished! (Or just don’t make payments to your creditors. You’ll end up in the same spot without paying someone to help you get there!)

Do you have multiple credit card debts which seem to just stack up on top of each other? Do these debts build up on different fees between each company creating addition charges each month which add up so quickly they triple the amount of debt you owe over a course of time? Do you feel as though you now have gotten yourself in such a deep state of debt you can no longer break free? If so debt consolidation may be the solution for you.

What is bill consolidation?

Bill consolidation is a plan in which helps a person that is in trouble with debt due to many different businesses due to be paid at the same time every month. This could be due to companies such as credit card businesses who add on additional fees each month which can total up to costing more than your total monthly payments to your debt, and in the long run these fees create a debt which can scale to double or triple the original debt owed.

Will a consolidation loan affect a credit score?

Debt consolidation will not hurt your credit score as long as you make on time payments each month to the consolidation company. You will also need to prevent any chance of debt while and after your consolidation plan to keep yourself financially stable thereafter. Debt consolidation can actually repair your credit by reporting to credit scoring companies of your successful timely payments, and clearing of debt.

A Long Island couple is home free after an outraged judge gave them an amazing holiday gift by forgiving their debt to ruthless bankers trying to toss them out on the street. Suffolk Judge Jeffrey Spinner wiped out $525,000 in mortgage payments demanded by a California bank, blasting its “harsh, repugnant, shocking and repulsive” acts.

The bombshell decision leaves Diane Yano-Horoski and her husband, Greg Horoski, owing absolutely no money on their ranch house in East Patchogue. Spinner pulled no punches as he smacked down the bankers at OneWest — who took an $814.2 million federal bailout but have a record of coldbloodedly foreclosing on any homeowner owing money. It erased up to $291,000 in principal and $235,000 in interest and penalties.

The Horoskis — who had been paying only interest on their mortgage loan that had no equity in the home. Horoski, who had begged the bankers to let him restructure the loan, said, “I think the judge felt it was almost a personal vendetta.” Dealing with the bank, he said, was “like dealing with organized crime.”

OneWest said, “We respectfully disagree with the lower court’s unprecedented ruling and we expect that it will be overturned on appeal.” It claimed it “has been extremely active in working with consumers on home loan modifications through the Obama administration’s Home Affordable Modification Program and other loan modification initiatives.”

The bank is owned by a private equity group that purchased the failed IndyMac bank. Yano-Horoski, a college professor of English and cognitive reason, and Horoski, who sells collectible dolls online, bought their 3,400-square-foot, one-level house 15 years ago for less than $200,000.

In 2004, court records show, they refinanced, paying off their original mortgage with part of a $292,500 sub-prime loan from Deutsche Bank. They used what was left for health care and for his business. The loan carried an initial adjustable interest rate of 10.375 percent, which soared to 12.375 percent. It eventually ended up being either owned or serviced by IndyMac, and the bank sued the couple in July 2005 when they began having trouble making payments because of Horoski’s health problems.

After a foreclosure was approved last January, Yano-Haroski successfully asked for a court settlement conference. Spinner excoriated OneWest for repeatedly refusing to work out a deal, for misleading him about the dollar amounts at stake in the case, and for its treatment of the couple over months of hearings.

OneWest’s conduct was “inequitable, unconscionable, vexatious and opprobrious,” Spinner wrote.

He canceled the debt because the bank “must be appropriately sanctioned so as to deter it from imposing further mortifying abuse against the couple.” The bank is involved in a similar case in California, where it’s trying to foreclose on an 89-year-old woman, despite two court orders telling it to stop.
